Welcome to Add Benefits. These Terms of Use ("Terms") explain the rules for using www.addbenefits.com and any related pages, forms, content, communications, and services that link to these Terms (collectively, the "Site"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
Plain-English summary: this Site is for general informational and business inquiry purposes. It is not insurance, legal, tax, medical, or financial advice; coverage and plan availability depend on carrier, administrator, employer, state, underwriting, and other eligibility requirements; and we may update or suspend the Site at any time.
1. Who these Terms apply to
These Terms apply to all visitors, users, employers, brokers, referral partners, applicants, and other individuals or entities that access or use the Site.
2. What the Site is for
The Site is intended to provide general information about Add Benefits LLC, our services, and related benefit, enrollment, broker, and employer solutions. Nothing on the Site creates an insurance policy, modifies coverage, guarantees savings, or forms a client relationship unless separately agreed in writing.
3. No advice or professional relationship
· Content on the Site is provided for general informational purposes only.
· The Site does not provide legal, tax, accounting, medical, or financial advice.
· Nothing on the Site should be treated as insurance advice, a recommendation to purchase any product, or a guarantee of eligibility, approval, pricing, tax treatment, or results.
· Any benefits, payroll, tax, or plan-related information is subject to applicable law, administrator requirements, employer plan documents, insurer terms, and other program conditions.
4. Eligibility and acceptable use
You agree to use the Site only for lawful purposes and in a way that does not harm Better Benefits, the Site, or other users.
· Use the Site to submit false, misleading, or unauthorized information.
· Interfere with the operation or security of the Site.
· Attempt to gain unauthorized access to accounts, systems, or data.
· Copy, scrape, frame, reverse engineer, or exploit Site materials except as allowed by law or with our written consent.
· Use the Site to transmit malware, spam, or unlawful content.
5. Information you submit
If you submit information through the Site, you represent that it is accurate and that you have the authority to provide it. You are responsible for keeping your contact details current and for ensuring that any information you submit does not violate any law or third-party rights.
6. Consent to contact, calls, texts, and prerecorded or autodialed messages
By submitting a form, requesting information, scheduling a call, signing up for updates, or otherwise providing your contact information to Add Benefits, you expressly agree that Add Benefits LLC and its representatives, service providers, partners, and agents may contact you at the telephone number(s) and email address(es) you provide, including by call, SMS/text message, and voicemail, for informational, account-related, appointment, follow-up, marketing, promotional, operational, and service purposes, as permitted by law.
You also expressly consent, to the extent permitted by applicable law, to receive calls and text messages that may be made using an automatic telephone dialing system, automatic dialing technology, prerecorded voice, artificial voice, or similar technology. Your consent is not a condition of purchasing any goods or services. Message and data rates may apply. Message frequency may vary.
You are responsible for providing a number that you own or are authorized to use. If your number changes, you agree to notify us before the change takes effect or as soon as reasonably possible. You understand that consent to contact may be revoked for marketing texts by replying STOP to a text message, where applicable, or by contacting us at privacy@addbenefits.com. Even if you opt out of marketing communications, we may still send service, scheduling, operational, legal, or transactional communications where permitted by law.
7. Privacy
Your use of the Site is also subject to our Privacy Policy. Our Privacy Policy describes how we collect, use, disclose, and safeguard personal information, including California-specific disclosures and rights where applicable.
8. Intellectual property
The Site and its content, including text, design, layout, graphics, logos, trademarks, service marks, software, and other materials, are owned by Add Benefits LLC or its licensors and are protected by applicable intellectual property laws. Except for limited personal or internal business review use, you may not reproduce, distribute, modify, publicly display, create derivative works from, or commercially exploit Site content without our prior written permission.
9. Third-party tools, links, and providers
The Site may include third-party tools, embedded content, scheduling tools, analytics tools, session replay tools, links, or references to third-party providers, insurers, administrators, brokers, or other partners. We do not control and are not responsible for third-party websites, services, content, products, or privacy practices. Your use of third-party services is governed by their own terms and policies.
10. No guarantee of availability or results
We may update, suspend, limit, or discontinue any part of the Site at any time without notice. We do not guarantee that the Site will always be available, uninterrupted, error-free, secure, or free from harmful components. We also do not guarantee that any inquiry, application, lead, enrollment opportunity, plan design, employer outcome, tax result, or business result will be available or achieved.
11. Disclaimer of warranties
To the fullest extent permitted by law, the Site is provided on an "as is" and "as available" basis. Add Benefits LLC disclaims all warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing, usage, or performance. We do not warrant that the Site or any information on it will be accurate, complete, current, reliable, or suitable for your needs.
12. Limitation of liability
To the fullest extent permitted by law, Add Benefits LLC and its owners, managers, officers, employees, contractors, affiliates, licensors, service providers, and agents will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or lost-profit damages, or for loss of data, business interruption, or loss of goodwill, arising out of or related to your use of or inability to use the Site, even if advised of the possibility of such damages.
To the fullest extent permitted by law, the total aggregate liability of Add Benefits LLC for any claim arising out of or relating to the Site or these Terms will not exceed the greater of: (a) the amount you paid, if any, to Add Benefits LLC specifically for use of the Site in the 12 months before the claim arose; or (b) US$100.
13. Indemnity
You agree to defend, indemnify, and hold harmless Add Benefits LLC and its owners, managers, officers, employees, contractors, affiliates, licensors, service providers, and agents from and against claims, losses, liabilities, damages, judgments, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your misuse of the Site, your violation of these Terms, or your violation of any law or third-party rights.
14. Arbitration at the Company's election
Please read this section carefully. It affects how disputes are resolved.
To the fullest extent permitted by applicable law, Add Benefits LLC may elect, in its sole discretion, to require that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, any communications through the Site, or your relationship with Add Benefits LLC be resolved by final and binding arbitration on an individual basis instead of in court. This election may be made by Add Benefits LLC at any time before or shortly after a lawsuit, demand, counterclaim, or other formal proceeding is initiated, to the extent permitted by law.
If Add Benefits LLC elects arbitration, the arbitration will be administered by the American Arbitration Association (AAA) under the AAA Consumer Arbitration Rules or, if those rules do not apply, under the most appropriate AAA rules then in effect. The Federal Arbitration Act will govern the interpretation and enforcement of this arbitration section. The arbitration may be conducted remotely, by documents only, by telephone, by video conference, or in person in Clark County, Nevada, as determined under the applicable rules or by the arbitrator.
The arbitrator will have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration section, except to the extent a court must decide issues that cannot be delegated under applicable law. The arbitrator may award the same individual remedies that a court could award on an individual claim.
You and Add Benefits LLC agree that any arbitration or court proceeding will be conducted only on an individual basis and not as a class, collective, mass, consolidated, private attorney general, or representative action, except to the extent such a waiver is prohibited by law. Unless prohibited by law, the arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
If a court decides that this arbitration section is unenforceable as to a particular claim or request for relief, then that claim or request for relief will proceed in court and the remaining claims will be arbitrated to the fullest extent permitted by law. If the class or representative action waiver is found unenforceable for a particular claim and that determination cannot be severed, then that claim will proceed in court and all other claims will remain subject to this section to the fullest extent permitted by law.
15. Governing law and court venue
These Terms and any dispute arising out of or relating to these Terms or the Site will be governed by the laws of the State of Nevada, without regard to conflict of law principles. If Add Benefits LLC does not elect arbitration, or if a claim must proceed in court, then the parties agree that the exclusive venue for such claim will be the state courts located in Clark County, Nevada, or the federal courts located in Nevada, and each party consents to the personal jurisdiction of those courts.
16. California rights and notices
California residents may have certain consumer and privacy rights under California law. Nothing in these Terms is intended to waive any non-waivable rights or remedies that apply under California law. If you are a California resident, please also review our Privacy Policy for California-specific privacy disclosures, including rights that may apply to requests to know, delete, correct, or opt out of certain data uses, where applicable.
17. Changes to the Site or Terms
We may update these Terms from time to time. Changes will be effective when posted to the Site unless a different date is stated. Your continued use of the Site after updated Terms are posted means you accept the updated Terms to the fullest extent permitted by law.
18. General terms
· If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
· Our failure to enforce any provision is not a waiver of that provision or any other right.
· These Terms do not create a partnership, joint venture, employment, agency, fiduciary, or franchise relationship between you and Add Benefits LLC.
· These Terms are the entire agreement between you and Add Benefits LLC regarding the Site and supersede prior discussions relating specifically to the Site, except for any separate written agreement signed by Add Benefits LLC.
